FUTURE OF GUEST TEACHERS AFTER 322 DAYS

After having a sigh of relief from supreme court ,guest teachers resumed their work in new academic session with the hope that govt will frame a policy of their regularization. However govt is equipped with all powers to frame policies and their implementation, but framing a policy in this particular case in not going to be a easy go affair. Going deep in the apex court's judgement one can easily comprehend about the seriousness of the court about implementation of scheme of regular appointments that govt has submitted in the high court.

see following observation of the supreme court:

   "We make it very clear that as directed by the Division Bench of the High Court, no fresh appointments of 'Guest Teachers' will be made from 1st April, 2012. However, since students also cannot be made to suffer on account of the delay in the appointment of regular teachers, we direct that the exercise indicated in the scheme,must be completed within the time specified in the scheme and no further extension or deviation therefrom will be permitted."

this clearly means that no guest teachers can be appointed in future and schedule given in high court must be strictly adhered to. Court has virtually set the dead line as:

 

"Till then, the 'Guest Teachers' may be allowed to continue to function, as they have been doing so far..."

      Now govt is legally bound to comply with the directions of the supreme court;if govt fails to comply then certainly this will be a contempt of court.Some more cases may be filed in courts on govt's failure to follow the time schedule. If govt tries to frame a policy ,certainly such a policy will also be challenged in courts of law.This all means this case has been entangled beyond its dimensions and no easy solution seems eminent.If govt go ahead with the advertisement in this month then this will be a alarm bell for guest teachers.
